Terms & Conditions

Welcome to the Saloon Blowdry Membership. On signing or completing your Membership Application Form, these Terms and Conditions together with Your Membership Application Form will constitute “the Membership Agreement”. You should only sign Your Membership Application Form if you have read, understood and agree with these Terms.


1. Definitions

1.1 In these Membership Terms & Conditions unless the context requires otherwise:


(a)
Commencement Date means the date You sign and submit your Membership Application Form to Us. Signing and submitting Your Membership Application Form may occur electronically.

(b) Fixed Term means the minimum membership term for the relevant Membership Plan which You have specified on your Membership Application Form. The minimum term depends on the period You have signed up for, e.g., 3 months, 6 months or 12 months.

(c) Instalments mean the fortnightly instalments of the Membership Fees which are direct debited from Your nominated account or credit card.

(d) Medical Reasons means a serious illness (as confirmed in writing by a qualified doctor) that would impact Your ability to utilise Your membership.

(e) Member means a person who completes and submits a Membership Application Form.

(f) Membership Application Form means the form You complete and submit which specifies the Membership Fees, Membership Plan and Fixed Term.

(g) Membership Fees means the fees that apply for the relevant Membership Plan specified on Your Membership Application Form as varied from time to time pursuant to these Terms & Conditions.

(h) Membership Plan means the category of membership specified in the Membership Application Form, being The Classic, The Everyday Bombshell, and the All Out Saloon Elite and any other categories of membership determined by Us from time to time.

(i) Minimum Term means a period equal to half of Your contracted Fixed Term commencing on the Commencement Date excluding those Members who have a Fixed Term of one (1) month.

(j) You and Your means the person named on the Membership Application Form.

(k) We and Us means Saloon Co Pty Ltd (ACN 619 658 561).


2. Your Membership

2.1 Membership Duration


(a)
You are entering into a contract with Us for the Membership Plan for the Fixed Term specified on Your Membership Application Form.

(b) You agree to pay Your Membership Fees on either:

(i) the Commencement Date in full; or
(ii) in Instalments by direct debit for the duration of the Fixed Term.

(c) By completing the Membership Application Form, You authorise Us (or a third party nominated by Us) to debit all Membership Fees from the nominated account or credit card in the Instalments in advance. You agree that it is Your responsibility to have sufficient credit in the nominated accounts so that payment is made to us on time and
in full.

(d) We accept no liability to You if Your direct debit payment fails for any reason, including due to insufficient funds and any penalties You may incur from your financial institution due to insufficient funds or credit.

(e) We reserve the right to terminate Your Membership (in our absolute discretion) for nonpayment if Your direct debit fails on more than one occasion.

(f) At the expiry of the Fixed Term, unless You apply for another type of Membership Plan or cancel Your membership, Your Membership Plan will be automatically renewed for the same Membership Plan and same Fixed Term. You can cancel Your membership pursuant to clause 4.3.

2.2 Cooling Off Period

Notwithstanding anything in these Terms and Conditions, all Members are entitled to a seven (7) day cooling off period starting from the Commencement Date whereby a Member can cancel their Membership Plan without incurring a cancellation fee.


3. Membership Benefits

3.1 Membership Benefits

In consideration for the Membership Fees:

(a) ‘The Classic Membership’ Members are entitled to:

(i) unlimited free washes, blow-dry and iron-styling between 10am – 4pm Tuesday to Friday; and
(ii) 10% discount off blow-dry’s booked during all other times.

(b) ‘The Everyday Bombshell Membership’ Members are entitled to:

(i) unlimited free washes, blow-dry and iron-styling between 10am – 6pm Tuesday to Saturday; and
(ii) 10% discount off blow-dry’s booked during all other times.

(c) ‘The All Out Saloon VIP Membership’ Members are entitled to:

(i) unlimited blow-dry’s during any of our opening hours Tuesday to Saturday;
(ii) a free wash, scalp massage and treatment, blow-dry and iron styling per month; and
(iii) one (1) complimentary glass of champagne per visit (noting that You will incur costs for any additional beverages that You order); and
(iv) 10% off the total price of all other hair, brows and makeup services provided by Us.

3.2 Saloon Services

(a) We have a first in best dressed policy for Members seeking to use their member benefits. Appointments at preferred times cannot be guaranteed but all Members will be served in order of priority that appointments are scheduled.
(b) Members can make requests for particular staff at the salon but such requests are not guaranteed and will depend on availability of staff.

3.3 Additional Services

(a) Any additional services including hairstyle, brow service or beauty services will be charged separately and are not included in the Membership Fees.

3.4 No In-store credit or reimbursements

(a) Failure to utilise Your membership benefits will not accrue in-salon credit or an entitlement to reimbursement for Membership Fees paid.


4. Cancelling Your Membership

4.1 Cancelling your Membership – One Month Fixed Term

(a) If You have a Fixed Term Membership of one (1) month, then You can cancel Your membership at any time before the Fixed Term expires but You are required to pay for the full Fixed Term.

4.2 Cancelling your Membership – All Other Fixed Terms

(a) If You have a Fixed Term Membership of longer than one (1) month then You can cancel Your membership at any time before the Fixed Term expires but:

(i) If You cancel during the Minimum Term then You must pay a cancellation fee which is calculated as 50% of the balance of Your Membership Fee for the remainder of the Fixed Term; or

(ii) If You cancel after the Minimum Term, then You must pay a cancellation fee which is the equivalent of one (1) month of Your Membership Fee.

(b) The exception to clause 4.2(a)(i) is if You need to cancel Your membership in the Minimum Term for Medical Reasons. If You need to cancel Your membership for Medical Reasons then the cancellation fee is one (1) month of Your Membership Fee upon proof of the Medical Reasons.

4.3 Cancelling your Membership – upon renewal

(a) We will give You fourteen (14) days written notice (by email or text message) prior to Your Membership Plan expiring.

(b) You can cancel the renewal of Your Membership Plan in accordance with clause 4.4 without any cancellation fee.

4.4 Cancellation Process

(a) You can cancel Your membership by giving Us notice of cancellation in writing by emailing: info@saloonco.com.au

(b) You must give Us at least eighteen (18) days notice of any cancellations.

(c) You are not entitled to any refunds for any Membership Fee payments that are already made at the time of cancellation.

4.5 Cancellation by Us

(a) We reserve the right to terminate Your Membership (in our absolute discretion):

(i) for non-payment of Membership Fees if Your direct debit fails on more than one occasion;
(ii) if You do not comply with the reasonable directions of our staff;
(iii) if You misuse our products, services, or facilities or use them for purposes other than the uses for which they were designed or intended;
(iv) if You are abusive or aggressive to staff or other clients or act in a manner that is lewd or provocative.


5. Changes to Membership Terms & Conditions

5.1 Changes to Membership Terms and Fees


(a) We reserve the right to change these Membership Terms and Conditions and the Membership Fees from time to time.

(b) We may only change Your Membership Fees at the expiry/renewal of Your Membership and We will provide you with fourteen (14) days written notice (by email or text message) of the change in Membership Fees.

(c) We may change these Terms and Conditions at any time, provided that we give You at least thirty (30) days written notice (by email or text message) before any proposed changes take effect.

(d) If You do not wish to accept the proposed changes You may cancel Your Membership without penalty provided that You notify us in writing within eighteen (18) days of receiving Our notice.

(e) If You do not cancel Your Membership then Your Membership will be varied and continue in accordance with any changes notified to You from the expiry of the period of the notice to You.


6. Assignment

6.1 Assignment by Us

We may assign or novate Your Membership Agreement to a third party without Your consent (for example, if we sell the business). If We assign Your Membership Agreement, We will provide You with thirty (30) days written notice. An assignment of Your Membership Agreement is not a cause or reason for cancellation of membership, notwithstanding any other clause in these Terms and Conditions.

6.2 Assignment by You

You may not assign or novate Your Membership Agreement to a third party. The rights granted under these Terms and Conditions are personal to You.
